Terms of Service

These Terms of Service ("Terms") govern your use of the SimplyNoise mobile app and website (collectively, the "Service"), operated by Reactor LLC ("we", "us", or "our"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SimplyNoise provides procedurally generated and guided ambient soundscapes intended for focus, relaxation, and sleep. The Service is provided for your personal, non-commercial use.

2. Eligibility

You must be at least the age of digital consent in your jurisdiction to use the Service. If you are under 18, you should review these Terms with a parent or guardian.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, subject to these Terms and the rules of the relevant app store.

You may not:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits it.
  • Re-sell, redistribute, or sublicense the Service, its audio assets, or its guided audio content.
  • Use the Service to build a competing product, train a generative model, or scrape its content at scale.
  • Remove or obscure copyright, trademark, or other proprietary notices.
  • Use the Service in any way that violates applicable law.

4. Purchases, pricing, and refunds

4.1 In-app purchases

Individual soundscapes and the Full Bundle are sold as one-time in-app purchases, not subscriptions. Prices are shown in the app and on the website in your local currency where supported.

Purchases are processed by Apple App Store or Google Play. Your purchase is governed by the terms of that store, in addition to these Terms.

4.2 Restoring purchases

You can restore prior purchases on a new device by signing in with the same Apple ID or Google account and tapping Restore Purchases in Settings.

4.3 Refunds

  • iOS / macOS: Refund requests are handled by Apple at reportaproblem.apple.com.
  • Android: Refund requests are handled by Google Play per its policy.
  • Web: The current web experience is free. If web purchases are later introduced, checkout-specific refund terms will be presented before purchase. Statutory rights (e.g. EU/UK consumer protection) are unaffected.

4.4 Free preview

Some locked soundscapes offer a short free preview. The preview is provided "as is" and may be modified or removed at any time.

5. Health and safety

The Service is not a medical device. SimplyNoise does not diagnose, treat, cure, or prevent any condition, including tinnitus, anxiety, insomnia, or hearing loss.

  • Do not use SimplyNoise while operating a vehicle or heavy machinery.
  • Listen at a moderate volume. Prolonged exposure to high-volume audio can cause hearing damage. The app shows a loudness warning above safe levels; please heed it.
  • If you have a hearing condition, are pregnant, have a history of seizures, or are using assistive listening devices, consult a qualified professional before use.
  • Discontinue use if you experience discomfort, dizziness, or any adverse reaction.

6. User-supplied content

The Service does not currently accept user-supplied content. If this changes, additional terms will be presented at that time.

7. Intellectual property

All audio, artwork, software, copy, and branding in the Service are owned by us or our licensors and are protected by copyright, trademark, and related laws. Nothing in these Terms transfers ownership of any intellectual property to you.

8. Third-party services

The Service relies on third-party platforms, including Apple App Store, Google Play, payment processors, and crash-reporting providers. Your use of those services is governed by their respective terms. We are not responsible for third-party services.

9. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Some jurisdictions do not allow the exclusion of implied warranties, in which case the above exclusions may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, in no event shall Reactor LLC or its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or hearing damage arising from misuse of the Service, regardless of the theory of liability.

Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, in which case the above limitations may not apply to you, and statutory consumer rights are unaffected.

11. Termination

You may stop using the Service at any time by uninstalling the app. We may suspend or terminate access to the Service if you breach these Terms or use the Service in a way that risks harm to us or other users. Sections that by their nature should survive termination (purchases, IP, disclaimers, limitation of liability, governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, except where mandatory consumer-protection laws provide otherwise.

If you are an EU/UK consumer, you retain the right to bring proceedings in the courts of your country of residence.

14. Apple App Store additional terms

If you obtained the Service from the Apple App Store, the following also applies:

  • These Terms are between you and us only, not with Apple. Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • In the event of a failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
